Purpose
If an eligible elector believes on reasonable grounds that a candidate has contravened the Municipal Elections Act, with respect to municipal campaign finances, they may apply to have an audit of the candidate's campaign finances. The Compliance Audit Committee (the Committee) reviews such applications and decides to grant or reject an audit. A compliance audit request for a school board trustee must be directed to the School Board.
For the 2022 municipal election a joint Committee has been established for the Municipalities of Aurora, East Gwillimbury, Georgina, King, Markham, Newmarket, Richmond Hill, Whitchurch-Stouffville and Vaughan.
Compliance Audit Process
Any elector entitled to vote in the 2022 Municipal Election may file a Compliance Audit Request for any candidate in the 2022 municipal election.
The eligible elector who requests an audit must file an application with the
Clerk of the Town of Newmarket after March 31, 2023. The application must be made using the supplied form. This form is provided as a fillable PDF. To complete the form you must save the form to your computer and then open it directly in Adobe Acrobat or Adobe Reader.
The application must be submitted by:
- June 29, 2023, or
- 90 days after the date the candidate filed their financial statement if filed within the 30 day grace period, or
- 90 days after the submission of their supplementary
filing.
The Clerk will receive the application and within ten days will send the
application to the Compliance Audit Committee.
The Committee is required to meet within 30 days of receiving the application
from the Clerk and determine if an audit is required or if the application is
rejected.
The decision of the Committee about granting or rejecting the audit may be
appealed to the Superior Court of Justice within 15 days of the Committee making
the decision.
If the Committee grants an audit, an auditor licensed under the Public Accounting Act, 2004 will be appointed to conduct an audit.
The Auditor will then conduct the audit to determine if the candidate has
complied with the requirements of the Municipal Elections Act with
regard to election campaign finances.
The Auditor will submit a report to the Clerk t, the
candidate, and the applicant.
The Committee has 30 days to meet and consider the report from the auditor.
The Committee will decide at this meeting whether to commence legal proceedings
against the candidate.
