    TAKE NOTICE THAT pursuant to Sections 36 and 39.2 of the Planning Act, and the Corporation of the Town of Newmarket has received an application from 1548373 Ontario Inc. requesting the removal of Holding (H) symbol for 514 Davis Drive. The purpose of this Notice is to inform you of the Corporation of the Town of Newmarket's intent to remove the Holding (H) provision for this development.

    The authority to lift the "H" has been delegated to staff by By-law 2024-01.

    An explanation of the purpose and effect of the removing the holding provision is included below. In making its decision on this matter, staff took into consideration all the conditions for removing the holding provision as outlined in Zoning Bylaw 2019-06.

    EXPLANATORY NOTE:

    The purpose and effect of removing the "H" from the property located at 514 Davis Drive is to permit the construction of a 6-storey mixed-use building to be comprised of office, retail, and self-storage. The holding provision is in place to require a future private road/ lane as shown on Schedule 5 of the Urban Centres Secondary Plan. The private road/lane is proposed to be constructed as part of the redevelopment of the property and the holding provision is no longer required.
